Buipe chief wins appeal case against Yagbonwura

The Judicial Council of the National House of Chiefs has given its ruling on the appeal filed against the current Buipe Wura Mahama Abdulai Jinapor the II.

After hours of deliberations, Abdulai Jinapor II, who was recently declared the legitimate Chief of the Buipe Traditional Area by a Tamale High Court was again, affirmed the rightful leader of the Buipe Traditional area.

The Yagbon Wura, who with the support of the Gonja Traditional Council, and the Registrar of the Council deskinned the Buipe Wura, was also dragged before the House of Chiefs but was exonerated of charges brought against him.

However, the Lepowura Bawa, who filed the appeal, has been charged to pay a fine of Four Thousand Ghana Cedis to the two chiefs.

On Thursday January 13 2011, the Tamale High Court, presided over by Justice Kwame Ansu Gyeabour held that the defendants were not the King Makers of the Buipe stool and therefore could not purport to destool Mr Jinapor.

The Paramount Chief of the Gonja Traditional Area, Yagbonwura Tuntumba Borisa, the Registrar of the Gonja Traditional Council and four other chiefs deskinned the Buipe chief on the grounds that he showed gross insubordination and disrespect to the Overlord of Gonja and the other chiefs by refusing to yield to appeals to forgive a sub-chief he (Jinapor) sanctioned.

The Yagbonwura and the other chiefs had prevailed on the Buipe chief not to carry out his threat to deskin his sub-chief but Mr Jinapor stood his grounds, an action that infuriated Yagbonwura Tuntumba and the other chiefs.

They consequently convened a meeting at which they deskinned the Buipe chief but Mr Abdulai Jinapor headed straight to Court to challenge the decision.

The court upheld Mr Jinapor’s argument that he was not given a fair hearing before the purported deskinment.

It thus awarded costs and general damages to the tune of GHc6,400 against the defendants.
